Terms of Service

Please read these terms before creating an account or subscribing. By doing either, you agree to them.

1. What this service is

DaySwingTrader is a market data and analytics service. We monitor publicly available options trading data from India's National Stock Exchange, detect unusually large or aggressive trades, and present them with supporting context such as open-interest change and a descriptive evidence score.

That is the entire scope of the service. We report what has already happened in the market. We do not predict what will happen next.

2. What this service is not

Specifically, and without limitation:

• We do not provide buy or sell calls, tips, targets, or stop-loss levels.
• We do not manage money, hold client funds, or execute trades on anyone's behalf.
• We do not offer portfolio advice or any personalised recommendation, and nothing we publish takes account of your financial situation, objectives, or risk tolerance.
• A label such as "bullish" or "bearish" on an alert describes the direction of the trade we observed — what someone else did — and is never our opinion on where a price will go.

Any decision you take after reading our data is your own decision, based on your own research and judgement. You are solely responsible for it.

3. Risk disclosure

Past patterns in market data do not indicate future results. Large or institutional trades identified by our service are frequently unprofitable, are often one leg of a wider strategy we cannot see, and may be hedges rather than directional positions. We publish our own unsuccessful flags precisely so this is visible rather than hidden.

4. Accuracy and availability

We take reasonable care to present data accurately and reconcile it nightly against the exchange's official published figures. Even so, we provide the service "as is" and "as available", and we do not warrant that it will be uninterrupted, timely, error-free, or complete.

Data may be delayed, incomplete, or incorrect for reasons including exchange feed problems, third-party outages, network failures, and errors in our own software. Do not rely on this service as your sole source of information, and always verify anything material against your broker or the exchange before acting.

5. Accounts

You must be at least 18 years old to create an account. You are responsible for keeping your login credentials secure and for all activity under your account. One account is for one person: accounts may not be shared, resold, or used by multiple people.

You agree to provide accurate registration information and to keep it current.

6. Subscriptions, billing and renewal

• New accounts include a 7-day free trial. No payment details are required to start it.
• Paid plans are billed in advance, monthly, six-monthly or yearly, according to the plan you choose.
• Subscriptions renew automatically at the end of each billing period, at the then-current price, until you cancel.
• Payments are processed by Stripe. We never see or store your full card details.
• We may change prices. Existing subscribers will be given notice by email before a change applies to their renewal.

7. Cancellation and refunds

You may cancel at any time from the account menu on the website, in two clicks. No email, phone call, or explanation is required.

On cancellation you keep access until the end of the billing period you have already paid for. The subscription then simply stops and you are not charged again.

Every account gets a full 7-day free trial with complete access before any payment is taken, so you can decide whether the service suits you before spending anything. For that reason we generally don't refund fees already paid for a period that is under way.

That said, we would much rather fix a problem than leave you unhappy. If something has gone wrong, if you were charged unexpectedly, or if you simply feel the service hasn't delivered what you expected, email us and we'll look at it properly. We read everything and we're reasonable.

Nothing here affects any rights you may have under the consumer protection law that applies to you.

8. Acceptable use

You agree not to:

• Scrape, crawl, harvest, or bulk-download data from the service by automated means.
• Redistribute, resell, republish, or share our data or alerts with people who are not subscribers, including in groups, channels or paid communities.
• Share your account, or use one subscription to serve multiple people.
• Attempt to gain unauthorised access to the service, or interfere with its operation.
• Present our data as your own, or use it to provide investment advice to others.

We may suspend or terminate any account that breaches these terms, without refund.

9. Intellectual property

The underlying market data originates from the exchange. Our detection logic, scoring, presentation, written material, videos, and the site itself remain our property. Your subscription grants you a personal, non-transferable right to use the service, and nothing more.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any trading loss, lost profit, lost opportunity, or any indirect, incidental, special or consequential damages arising from your use of, or inability to use, this service — whether or not the data was accurate, delayed, or available.

Where liability cannot lawfully be excluded, our total liability to you is limited to the amount you paid us in the twelve months preceding the claim.

11. Changes to these terms

We may update these terms. The "last updated" date above will change, and material changes will be notified by email to registered users. Continuing to use the service after a change means you accept the revised terms.
